Criminal Justice in Action Case

As was highlighted in this chapter, criminal profiling based on race is real and it is supported by different statistics that reveal evidence of disproportionate racial involvement in crime.  Throughout this chapter, the extent of racial profiling has been proved in different cases and this is even reflected in the rate of racial incarceration. Mainly, this particular act of discrimination on basis of races has eminently been rooted in natives, whose suspicion on the threat posed by the foreigners dominates the entire actions. Though the law stipulates against any discrimination on the basis of races or ethnic groups, other factors may necessitate racial discrimination on the basis of the same law. Considering the strategies on the war on terror, many Muslims found themselves in situations of being profiled on the basis of the American national security (Gaines & Miller, 2010).

Arguments against the Action Made by the Police

According to Bonilla (2009), the US constitution protects all the people against any form of discrimination on the basis of ethnic groups or race. Certainly, the case presented in this chapter reveals how racial discrimination is largely exercised despite being against the law. Considering the initial cause of manhandling of the six Muslims by the Minneapolis Airport Police, it is clear that this was against the law. It should be remembered that, the men profiled were initially alleged for making noise, which was a normal practice in their religion. As Glover (2009), holds, it is a constitutional right of every individual to exercise the religion he/she wishes, provided it conforms to the law. It should be remembered that, the six men were only having their ritual prayers, which contributed to their being profiled. On this basis, this particular action by the police can be described as being on racial discrimination basis.

More so, this situation clearly reveals how the police misuses their power and influences on racial basis. Considering that, the six Muslims where shouting the word ‘Allah' in their prayer, the probable cause of the profiling can be attributed to the words included in the prayer. With the word ‘Allah' mainly used in the Islamic religion, it was clear to the police that the people praying were Muslims. Mainly, the initial suspicion by the police to the Muslims as being terrorists was initiated the knowledge that they where not Native Americans. Lindsey (2010) considers the act of racial discrimination as being mainly attributed by the religion an individual is coming from. Since for long Muslims and Americans have not been at par, with Muslims alleged for terrorism, racial profiling between Muslims started being practiced coldly.

Though the six Muslims were alleged for switching off their seats and subsequently getting into their normal prayers, their physical appearance was the ultimate cause of such manhandling. According to the Race Relations Act, as reflected in the constitution, an individual should not be discriminated on the basis of race, color, or their national background in services and goods provision. Considering the initial reason for the annexing of the six Muslims by the police, such action was unlawful and totally against humanity. Since the law governs people's actions, it was absolutely unlawful for the police to consider the six Muslims as ‘terrorist suspects' just because of their religion. As Barnes (2009) holds, it is usually the right of every individual to exercise his/her freedom of action, provided it does not lead to a pre-judged act of committing a crime. With the Muslims only getting involved in a prayer, such an act did not warrant their being arrested by the police. Certainly, racial discrimination seems to prevail in the entire process of the police manhandling the sis suspects.

As revealed in this case, hate crime is committed against the six Muslims on the basis if their religion and race. It should be clearly noted that, the year 2002 in America was associated with high degree of hate by Natives against the Muslims on the basis of 09/11 act. Statistics prove that, more than 49% of hate crime cases were reported, since Muslims were entirely feared on allegation of being associated with terrorism. On this basis, ethnicity can be described as having constituted to the annexing of the six Muslims by the Minneapolis police force.  According to Gaines & Miller (2010), it is the constitutional right of everybody, regardless of his/her ethnic group, to be protected by the law. In this regard, the Minneapolis police should be questioned about their mistreatment to the six Muslims. According to international human rights Act, all people from different regions and races have equal access of services offered to the other people. Generally, the act of having the police mistreat the six Muslims on the basis of mere suspicion without any tangible evidence of the alleged crime renders the police unlawful in their actions.

According to the International Human Rights Act, all the people have the right to exercise their cultural practices, religious rituals and use their language without being discriminated. More significantly, all diverse cultural groups of the world are brought out as having the right to enjoy their cultural or religious heritage without interferences. The act of the Minneapolis police to manhandle the six Muslims just because they were practicing their religious rituals seems to violate humanity and the law governing freedom of cultural practices. As evidenced by Gaines & Miller (2010), the act of prejudice on religious basis is an unlawful act, since such an act would be violating the freedom of cultural practices. Generally, the situation observed by the police mistreating the Muslims on the basis of their race can be argued as an act against freedom of religion or cultural practices.
